The globalisation phenomenon has resulted in the business expansion on an international level. Said process has led to a demand increase of assessors and law professionals, who have the required knowledge of international law at a global level to answer to these needs.

The specialisation course in International Litigation and in the EU answers efficiently to the requirements that companies demand at an international level.

The programme is aimed at those law professionals willing to train in the law area that regulates the law aspects in the procedural, civil, commercial, labour and tax fields; as well as acquiring knowledge in the negotiation and international arbitration areas. All of this in order to obtain the adequate aptitudes and to have a complete knowledge of the main law aspects to solve conflicts with immigration elements that circumscribe them in the International Private Law, EU Law and Human Rights disciplines.

5. Information resources

The Library Service is conceived as a support unit for study and research. Its most important objective is to meet the educative and scientific demands. It has convenient opening hours, including weekends, with the best computer equipment. In addition, the UAO CEU offers to all the University community a vast digital storage, with free access to its publications from its docent, research or institutional activities carried out by teachers, students or former students from the University.

  4. Notification and transfer of judicial and extra-judicial documents within the EU and third states
  5. Acknowledgement and execution of foreign judicial resolutions and European executive title deeds
  6. European Small Claims procedure, limited amount process, actions before the Community Trade Mark Courts

International arbitration and ADR (Alternative Dispute Resolutions) (1.5 ECTS)

  1. Mediation, conciliation, ADR (Alternative Dispute Resolutions)

  3. The "legal negotiation”
  4. Acknowledgement and execution of foreign arbitration resolutions
  5. Precautionary actions in the arbitration proceedings

Procedural Law of the European Union. Appeals before the CJEU (0.5 ECTS)

Human Rights: Current concept, legal framework and jurisdictional protection (0.5 ECTS)

  1. Divorce, separation and nullity. Legal competence, applicable law and acknowledgement and execution of foreign judicial resolutions
  2. Food law: Legal competence, applicable law and acknowledgement and execution of foreign judicial resolutions
  3. Protection of the individual (elderly and minors)
  4. International adoption
  5. Succession law: Legal competence, applicable law and acknowledgement and execution of foreign judicial resolutions

Commercial Law (3 ECTS)

  1. International Company Law. Company creation and internationalisation. Freedom of establishment in the EU
  2. Industrial and intellectual property: Legal competence, applicable law and acknowledgement and execution of foreign judicial resolutions
  3. Consumer rights
  4. Electronic commerce
  5. Cross-border insolvency proceedings: Legal competence, applicable law and acknowledgement and execution of foreign judicial resolutions

 

Evaluation system

The evaluation system of this course is continuous: the student must turn in at the end of every module one or more proposed projects. Those must be procedural documents, lawsuits and resolution of practical cases. Besides, only those students attending at least an 80% of the sessions will be evaluated.

PAYMENT METHODS

Students taking the course of International Litigation and in the EU must pay the full registration fee before the course starts. The Universitat ’s Postgraduate and University Extension Service will issue an enrolment form to the prospective students so that they can pay the fee at one of the financial institutions listed on the enrolment form. The students will have 15 calendar days to make the transfer.

The Universitat Abat Oliba CEU has credit lines with different financial institutions, so that students can finance their programme under preferential terms. ADMISSION PROFILE

The specialisation course in International Litigation and in the EU is aimed at graduates in Law, Political Sciences, Economic and Business Sciences, Business Management, International Relationships. It also aims at professionals such as lawyers, attorneys and legal practitioners, and in general to everyone interested in developing their professional career in the Law field and in the international legal profession and are interested in obtaining a specialised training of the highest academic and practical level in this multidisciplinary subject.

OBJECTIVES

  • Knowing the international regulations in the civil, commercial, labour and Human Rights areas.
  • Knowing the EU regulation tools and the international agreements at a procedural level, in order to offer solutions of the international law conflicts.
  • Knowing the tax aspects at an international level.
  • Knowing how to solve out of court the law conflicts (arbitration and ADR).
  • Obtaining competences and professional abilities in oral and written communication to apply them on the negotiation processes.
